1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the My Three Circles mobile application ("App") operated by Three Circles Psychology Pty Ltd ("we", "us", or "our").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

My Three Circles is a wellness application designed to help users track their emotional wellbeing using a three-circle system based on Compassion Focused Therapy principles. The App provides:

• Emotional state tracking tools
• Educational content about emotional wellbeing
• Meditation and mindfulness resources
• Progress tracking and visualisation features

3. Acceptance of Use

Intended Use

The App is intended for general wellness and self-awareness purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of qualified health providers with questions you may have regarding mental health or medical conditions.

Age Requirements

You must be at least 13 years old to use this App independently. Users under 13 may use the App with parental supervision and consent.

4. User Accounts

Anonymous Usage

You may use the App without creating an account. When using the App anonymously, your data is associated with your device installation and cannot be recovered if you change devices or reinstall the App.

Account Registration

You may optionally create an account to sync your data across devices and enable additional features. Account creation is available through:

• Email and Password: Register using your email address and a password you create
• Sign In with Apple: Use your Apple ID to create an account
• Sign In with Google: Use your Google account to create an account

Account Security

If you create an account, you are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use of your account

We are not liable for any loss or damage arising from your failure to protect your account credentials.

5. User Responsibilities

You agree to:

• Use the App in compliance with all applicable laws and regulations
• Not use the App for any unlawful or unauthorised purpose
• Not attempt to interfere with or disrupt the App's functionality
• Not attempt to access other users' data or our systems unauthorisedly

Account-Specific Responsibilities

If you create an account, you additionally agree to:

• Provide a valid email address that you have access to for account verification and password recovery
• Keep your account credentials secure and not share them with others
• Not create multiple accounts for the purpose of circumventing restrictions or abusing the service

6. Intellectual Property Rights

Our Content

The App and its original content (excluding user-generated content), features, and functionality are owned by Three Circles Psychology Pty Ltd and are protected by international copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of any notes or personal reflections you enter into the App. By using the App, you grant us a limited licence to store and display this content solely for the purpose of providing the App's services to you.

7. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to our privacy practices as described in the Privacy Policy.

8. Disclaimer of Warranties

As-Is Basis

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of content

No Medical Advice

The App does not provide medical or mental health advice. The emotional tracking tools and educational content are for informational and wellness purposes only. We make no representations about the suitability of the App for therapeutic or medical purposes.

9. Limitation of Liability

To the maximum extent permitted by law, Three Circles Psychology Pty Ltd shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or use
• Personal injury or emotional distress

arising from your use or inability to use the App, even if we have been advised of the possibility of such damages.

In jurisdictions where limitation of liability for consequential damages is not permitted, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Three Circles Psychology Pty Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your violation of these Terms
• Your use or misuse of the App
• Your violation of any third-party rights
• Any content you submit through the App

11. Modifications to the App and Terms

App Changes

We reserve the right to:

• Modify or discontinue the App (or any part thereof) at any time
• Add or remove features
• Update the App for technical or operational reasons

Terms Updates

We may revise these Terms at any time. Material changes will be notified through the App or other appropriate means. Your continued use after such changes constitutes acceptance of the new Terms.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the App will cease immediately. All provisions of these Terms that should reasonably survive termination shall remain in effect.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in New South Wales, Australia.

14. International Use

The App is controlled and operated from Australia. We make no representations that the App is appropriate or available for use in other locations. If you access the App from outside Australia, you do so at your own risk and are responsible for compliance with local laws.

15. Apple App Store Terms

Your use of the App is also subject to Apple's terms and conditions, including:

Apple-Specific Provisions

• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any product warranties
• Apple is not responsible for addressing any claims relating to the App
• Apple is not responsible for any third-party intellectual property claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Three Circles Psychology Pty Ltd regarding the use of the App.
